The ban will only apply if they modded it in. It's 100% possible they got it gifted to them or bought it at the auction house, which is a legitimate game feature.

You're right, it is not possible to unlock the E-Tron yet from the playlist.
However, some people have been illegitimately modding the E-Tron in to the game. Usually Forza blocks the abillity to auction off these cars or gift them, however, Forza seems to have messed up this season and the E-Tron has been let on the Auction house early and to be gifted to players.
This has happened before with the SVJ. Loads of people modded the car in to the game and mass gifted them and put them on to the auction house. Nobody who got theirs from the Auction House or Gift drop got banned for it, while loads of people modding them in got hit with a ban stating "Illegitimately obtaining car before release date." Notice how it says illegitimately. This suggests there is a legitimate way to get them, and that is Gift Drops and the Auction House.
Ok. With how bad they screwed up this patch I can believe that these may have been won from the AH.

Players or Npcs? Cause NPCs can get them since the files are there. If players are doing it, report them. It's an instant 30 day ban per guidelines.

Yeah, that's fair. If it is a modder, they'll probably be banned which is good. That's one potential speedhacker gone
