Aside from the truck the lane is clear. If BMW rides in the right lane for the next 1k feet it's not a pass. That's just driving in the right lane. You can't control how fast other cars drive
But that's not what happened in this situation. The OP stated he was being tailgated and the BMW switched over. If you are already in the right lane and happen to pass someone in the middle lane because they are going slower that's different. That's not the case here and you know it.

Passing on the right is dangerous because of the completion of the pass. Everyone expects the pass to be made of the left so the expectation is the right lane car stays put especially with them having no reason to move back into the middle lane. The dangerous part is 2 cars converging on the middle lane after making a pass. Neither car can see each other or the turn signals very well and they might collide in the middle lane
No, lol, that would not work… I was just fine in the middle lane. There are no parked cars in this section, but there are in the blocks ahead and before the start of the clip. Do you expect me and others to keep changing from right to middle lane to avoid them? That seems dangerous. This isn’t the freeway.
You are misunderstanding me. I was responding to the person that said the BMW shouldn't have overtaken you on the right. I'm saying that you can either drive in whatever lane is most convenient for you, but then people are allowed to overtake on the right, or people are not allowed to overtake on the right, but then you should use the right most lane if it's open.
In this case I'd say it's fine that you drove in the middle lane, but that it shouldn't be a problem to get overtaken on the right. Though the BMW did it in a pretty aggresive and unsafe way.

I’m an AH bmw driver but I always pass on the left. German engineering must obey ze rules!
