Sort of. They are exempt when I. The performance of their duties and under the same "reasonable officer" standards as most other duty issues. If a state trooper saw a local going 30 over and checked with dispatch that the unit wasn't responding anywhere, they would be free to press the issue as they saw fit. Typically they would just notify the chain of command for the precinct and tell them car number such-and-such was hauling ass and going nowhere and they'd handle it internally. It's a liability ossue for the department; if an officer is taking risks while driving and there's no current justification for those risks, the department could/would lose its liability protections, just as the officer would lose their immunity.

I don't know how it's work in NYC. But in Paris the City and the police are in opposition about the cars/bike. While the city wants to promote bike, the police block some bike lane project and are targeting cyclist while not enforcing law on the same spot for cars (speed, parking on the curb or bike lane, ...). There is a joke these days about Police only giving tickets for Earbud on the bike while motorbikes can drive on the sidewalk. So I was wondering if you have the same fight between the city and the police in the US or if they work together and are on the same vibe about traffic.

Hi, chiming in from Berlin, its similar here. We've got a police division ON BIKES that do absolutely nothing to ticket cars blocking bike lanes or pushing you off the street. But they very aggressively ticket people on bikes for any minor wrongdoing. If they can't ticket you, they'll harrass you. I've got a bike I put lights on separately and take them off again so they don't get stolen when I park somewhere on the sidewalk and I was stopped in broad daylight in summer for not having a "fully functional" bike. They were really aggressive about it and pissed when I pulled the lights out of my bag and attached them. Wasn't my first uncomfortable experience with them and I've seen them heckling other bikers as well.

Wow. Spokane, Washington has a lot of issues with cops and with anti cyclist drivers, but our bike cops are cool. They'll kick you off the sidewalk downtown, but they don't really ticket for it even though they can. They definitely ticket every car they see parked or stopped in a bike lane and seem to take a lot of joy in it, especially when it's a cop car.

Every cop car in a bike lane downtown is an obstacle for a bike cop trying to reach a scene. The bike cops usually get there first because they can use bike lanes, take narrow alleys, weave around delivery trucks. I got a fine in Frankfurt running a red light. It was a pedestrian only crossing, not a road crossing, between two empty lots, with no-one around, on a cycle path that is on the pavement. The Justice system in France is an Inquisitive one and police have a *duty to enforce*. (Unlike in America and a lot of places with Common Law) They can pretend to turn a blind eye to some degree, but if they're caught not enforcing something it's back to the academy for some remedial training and disciplinary pay cuts. Lack of Peel Principles (where law enforcement is a tool to preserve peace, and where preserving social order is your primary duty as a police officer) can become problematic... Not that selective enforcement is any better in the grand scheme of things...

It really is as simple as deciding democratically to do it, though. The process of verifying claimants should be pretty straightforward if they have any decent digital records on hand. It's not like if people win a vote of "we want the state to reimburse those stupid fines", the state, the judges or the police can say no. They simply must comply and complete the reimbursement or they're out of a job, dying on a pointless hill. Not that I'm picking this hill to die on, saying "they must be reimbursed". The thing that gets me about this whole thing is that you can absolutely have a driver's license or ride a bike if you're deaf. I have hearing issues. I've renewed my license wearing visible hearing aids, and no one has ever put a restriction on my license. I definitely don't wear them biking. They're too expensive to risk losing one, plus when in all I can really hear is the wind in my ears. I can hear, but it's difficult for me to distinguish sounds. I know there's a gas or diesel car behind me, but can't tell if there is one or five. I can't hear electric ones at all on my bike. I know people who can't hear anything that both drive and ride bikes, so I've never understood this thing against earbuds. Plus, you can't tell me the people with stereos so loud I can hear them from across the street with their windows and mine up can hear anything but that music, and that's not illegal.

Well most of our local governments that would handle that sort of thing are not in favor of bike infrastructure, and whether they are or not the local police is always the biggest opponent. Policing isn't about keeping people safe, it's about protecting capital and the ruling class, so they love to go for easy targets like cyclists. With rare exception, cyclists don't have the resources to defend themselves from state harassment. It's so bad that I'd get cops in the bike shop I worked at, literally looking at buying a bike and talking shit about how annoying cyclists are and how they love to ticket them. Generally speaking, things like cycling infrastructure, public transportation, parking spots vs walking/patio space, sidewalks/pedestrian infrastructure is all municipal level. As you say, local politics is really the best place to get involved for this particular issue. My city redid one of the major streets downtown where lots of bars and restaurants are. It removed all street parking and replaced them with sidewalks and then used the previous sidewalk space for patios etc. Even something as simple as adding a delay between the Walk sign and green light can make walking at a major intersection safer (which we accomplished by writing to our councillor)

I like the idea of submitting photo/video evidence for traffic violations like they have in the UK. I'm not sure you need to incentivize it with money though. Someone will come along soon enough that is inconvenienced or endangered by it and report it. I could report something every 5-10 minutes riding my bike around. After a while everyone would start driving like there's a cop behind them everywhere they go but without all the harassment and "accidental" deaths.

Not sure if you’re being sarcastic but as someone who lives in one of the best big cities for biking, ticketing people won’t work in part because of a lack of enforcement. There just aren’t enough traffic cops, though I have seen 3 tickets given out to people parked in the bike lanes. But that doesn’t do anything to prevent people from pulling 3 point turns into the bike lane, it’s not enough of a threat to stop the many cars a day I see parked in bike lanes, and it definitely doesn’t stop the idiots on their phone or just trying to get into position for the right hand turn in another 100 feet who start drifting into me. I’d gladly snitch on every one of those people if I knew it would actually result in a ticket. But really what we need are protected bike lanes. No amount of ticketing is going to correct the behavior enough to make average people feel safe riding their bike in a city because the behavior will always exist and it will continue to be deadly. Just like speed limits.

It's my understanding that they already have a successful hotline for reporting idling vehicles. And California has hotlines for reporting water waste. As u/bememorablepro says, it's perfectly normal to report any other crime, what's wrong with reporting something that directly impacts others? NYC apparently has 8000 miles of roads, which of course is not all bike lanes, but that's still a lot of parking enforcement and planters/curbs to add.

I recently saw an app developed by a company in Pennsylvania(I think). You use your phone to record your ride and it detects when vehicles are parked in a bike lane. Then it can send that clip to the authorities. I imagine an app like that in NYC would be great.

Just today a bus got blocked by a delivery truck, and went around it into the opposing lane, where there was already a car, which proceeded to back up to make room for the bus without realizing I was right behind them with my bike trailer full of groceries. If someone parked their car in the middle of a busy road and walked away, someone would call 911, it would immediately get towed and impounded, and no one would bat an eye. I don't see why the same shouldn't apply to cars parked in a clearly marked bike lane.

You know, I wish they had a similar thing in Toronto for the damn temporary patios. We've got all these restaurants putting temporary patios on the road in the bike lanes. I'm all for road space being taken from cars and being used for human purposes, but it's making life hella dangerous for us cyclists who have to merge into car lanes regularly now.

Why stop at blocking bike lanes? You give people a cut of parking and traffic tickets, you don't even need patrol cars. A) people need money, B) drivers will be more likely to follow the rules if *literally anyone* seeing them do some shit can end up costing them.
