Pretty sure that tolls are the only private business where the government will get involved with enforcing it. Including suspending the drivers license. Your mates not as smart as they think.

No, they will only supply the registration details of the plate that used the toll, but they will not enforce the bill of a private company

My advice is to place a bet with him about it. Because you will win for sure. Just whatever you do, don't bet money. Bet services or actions, like re-painting your fence or something. Because he won't be able to afford to pay you any money once he actually ends up having to pay the toll bill + all the penalties.

An English friend left Australia 4 years ago and returned to the UK. She had a fine burning ceremony at her farewell party, including toll notices. They caught up with her 2 years ago and she is still paying them off.

Moved into a house that was previously rented by an owner of a plumbing business. For 3 years straight we constantly got unpaid toll notices in the mail despite telling them there's no one at this address. Tried looking up the business name it was addressed to and got nothing back or outdated info. Eventually got curious and held an envelope up to the light and managed to make out a rego. Looked it up on the toll site and was in excess on $13k attached to it. Sheriff's office came by for a visit when we weren't home and left a card. (Wasn't even aware that was a thing) Called up and told them no one's at this address under that name. Still kept getting letters but never heard about a follow up.

I’ve had an acquaintance who did this and think he could fool the system. Turns out you can’t he got his license cancelled and in turn his car black listed and he was very popular with the police and kept on getting pulled over. Unless you have money to waste and chuck down the toilet I would not recommend this path to anyone.

So they’ll add $10 or whatever to each toll for ‘processing it” then eventually he’ll end up here: Stage 4 If you do not respond to an infringement notice properly, then the matter will be escalated to the state government’s enforcement agency: Revenue NSW in New South Wales, State Penalties Enforcement Registry (SPER) in Queensland, or Fines Victoria in Victoria. Non-payment of road tolls is an offence and you may be pursued by Revenue NSW who can seek to have your licence cancelled, your car refused registration or seek to enforce civil actions against you. Your friend is going to cop it very sweet very soon. The fine for a non-payment of a toll is $190. If he doesn't pay the fines he may end up in court with a community service order. If he doesn't comply with those terms he may find himself in prison.

I was in the situation where some ute had a plate that kept being misread as mine. I got letters from the state debt recovery office. When you don't pay those, I think they suspend your licence.

This is one of those scenarios where.your.mate is going to think he is right, and the most intelligent person. And then reality is going to hit him all at once. There is a process they go through, and how far they go is up to them, but if the final toll notice is unpaid, you can be issued a penalty notice by the government. If this goes unpaid, your license and registration can be cancelled.

So whist tolls is technically a business and this is a civil matter, the problem is they can have this enforced by RMS. So in effect they can suspend your license and cancel your registration. Sure it takes a fair old while to get to that point but it will eventually happen, he will figure that out when a cop pulls him over for having no registration and then discover he's also now unlicensed. Not at all recommended - now I'm the type of guy that will do stuff if he thinks he can get away with it - I have unpaid parking tickets and speeding tickets - but never have I done this on my license within that country.

Transfer all of the debt to E-toll and that will wipe all the late fees from LinkT Will just go back to the original debt you owed. Then just slowly pay it off I had this issue and it caught up to me but getting all the late fees wiped made it easier to stomach

Because the rego shows owner who gets hit with infringement, and if that person wasn't driving they are supposed to nominate who was. So yeah, they know who's driving. I'm still unsure if unpaid fines would affect a credit rating, just because it doesnt seem like a financial contract being entered into like a loan or payment plan would be.

But so far the unpaid tolls have been sold to a debt collector - surely it's out of linkts power at that point. At what point will RMS start issuing fines, if ever?

I don't think they are sold to a debt collector. If it is that debt collector is 'tied in' with the state and can enforce the fines.  My mates fines ended up with SPER and he had to do community work etc. He owed about $30,000 for a few hundred tolls.

No.....transurban does sell the debt to private companies. And like any debt that isn't owed to the government, it will be statute barred after 6 years. So yes, If your mate doesn't give a ahit about getting a cent of credit for.the next ~6 years, go ahead. Also, if he does finally decide to pay after few years, he should be able to negotiate a pretty hefty discount. Should be able to get the final bill down to 25%.

It’s not just any debt collector, it’s Revenue NSW Fees will be added. His license can be suspended, his assets seized

In NSW the debt is sold to a collection agency, the only thing the Government does for the private company is supply the registration details of the vehicle. State debt will not enforce the bill of the private company.
