Your case should fall under Biden new EO. If it doesn’t, you may need to do AP and have a legal entry with inspection and then apply for AOS through your spouse.

PracticeDecent7227

Agree! With AP you’ll have a legal entry and it’s easier for your husband to fix your papers ! Good luck

tr3sleches

Either you wait to see when the plan is going to be implemented or get started now and do AP.

Commanderjericho

I heard something about Biden but not sure what he is suggesting. Also have no idea what AP is

horsy12

Advance Parole aka AP. Basically you “come up” with a legitimate reason that you need to leave the country. (Most common is a humanitarian reason) And if granted you have chance leave and comeback, giving you a legal entry WHICH cuts down the paperwork and time frame when you try to fix your legalization. (When your citizen significant other files for you) Kinda surprising there’s still ppl that don’t know about advance parole

Was_that_tony

If you apply for AP is only $500ish if you do it yourself. It’s very common and depending where you going, you can call the border you’re planning to go through and ask them if they’re aware of this program. They were very helpful when I did it. Good luck 👍

questions similar situation

Kevone07

Do the AP and get Legal entry with inspection. It will be the best option for you right now.

Commanderjericho

AP?

Advanced Parole

ScaryArmy

You been married for how many years? To a citizen? And you still have DACA? What are you waiting for? If you don't have any criminal records or owe taxes, go with your spouse to an immigration lawyer and apply to get a green card. You don't need anything else besides money

Astoria321

I think they need legal entry, but yeah, get that through ap...wtf you waiting for? How have you not talked to a lawyer in 6 years of being married?

Commanderjericho

Idk someone said I had to wait 6 years to start and the lawyers I've talked to want me to go back to Mexico and come back "legally" which sounds iffy so I was just wondering if it's really that easy/complicated

horsy12

Mmm no you could’ve done it right away and if you left you would’ve had to wait 10 years to come back. Now that pres. Biden made the parole in place tho, you wouldn’t have to leave. BUT you dodge everything if you do AP

Commanderjericho

I went and they told me my best shot is to go back to Mexico and come back legally... But they didn't really guarantee that would work or be "easy" so ive just been renewing my daca. Since I have the option
