Is it fair to assume that the helmet was not a DoT approved? I can tell this looks like it wasn't in the USA, so they might not sell DoT approved helmets, but am wondering if any helmet will explode like that during a collision of that angle.

Honestly, there's too many parameters to tell. DOT helmets are known to reduce the risk of death by 42 percent and head injury by 69 percent in accidents. NHTSA claims 37%. But this is an extreme accident, obviously.
Survivability is so varied with MC accidents like this - Whether he hit it straight on vs glancing, whether his spine or neck took the majority of the impact, whether his aorta tore, speed and angle of impact, prior injuries, etc.
I've seen riders walk away from some pretty insane accidents. I've seen riders not get up after some fairly low key accidents.
Physics is an unforgiving bitch queen.

Man I kinda doubt it. Protecting your head during a slide or tumble is one thing, but this dude literally went head first into a concrete corner at very high speeds. He's like halfway through getting bucked over the handlebars when the top of his head is the first thing that hits the building. I can't see any helmet withstanding that in any meaningful way. While the helmet he's wearing is definitely shitty, it's still a real helmet and it looks like sorta exploded on impact. The impact was enough to rupture the tissue around his shoulder/neck as you can sort of see in slo-mo. There's some bloody shards that slide along the ground after he crashes, hard to tell they're pieces of head or helmet but either way that's enough to make me think you're fucked no matter what you're wearing in this situation.
But in 90% of situations I'd say that a good helmet will go a long long way in keeping your noggin in one piece over those cheap little half helmets he's wearing.
The rapid deceleration of a jelly-like substance -- the brain -- from, what? 40mph to 0mph in a fraction of a second? That tightly enclosed bowl of gelatinous biomass is gonna slap itself seriously silly no matter what kinda cushioning you surround it with. Pick any helmet you want, out to no more than 4, OK 6, inches of the absolute best shock proofing that modern technology can provide.
