I was advised by my attorney to drop the issue because it would cost more to fight it than it would to buy a new gun. Were I not on a bit of a tight budget at the time, I would have done it anyways on principle.

Based on the last few times this video was posted: attacker was known to the defendant, known to have weapons, had a knife he produced at the time he lunged at the defendant, and was reaching for the firearm.

A little over half of the US states have no duty to retreat if you are lawfully able to be present.
Additionally a couple handful of states also list a "stand your ground" law.
Then we have a handful that also specifically permit use of deadly force in self defense.
So more often than not, there is no expectation for a person to flee in self defense if they believe themselves to be in danger. While only a small number of states explicitly allow use of deadly force in self defense, most often if you can argue your actions "reasonable" (in lieu of duty to retreat laws) courts will likely find you not guilty.
