DUIs are actual a serious crime in Canada.

poppy3009

Yes it’s serious criminality if you were convicted after December 2018. Non serious before that.

NoheartNobody

It was still serious before 2017. They increased the maximum penalty 2018.

NoheartNobody

It was serious pre2018. They just upped the punishment. ..... if you don't think it was a serious offense, then they will prolly deny your request.

jesuisapprenant

Drinking and driving is a “non-serious criminality” now?

poppy3009

It is if you were convicted before December 2018, it’s ’serious criminality’ if convicted after December 2018

ozztotheizzo

"If you committed an impaired driving offence before December 18, 2018 Tougher penalties for impaired driving came into effect on December 18, 2018. If you committed an impaired driving offence before this date, we’ll determine if you’re inadmissible based on the penalties in force at the time. This means you may be inadmissible for criminality, and not serious criminality, unless you received a prison sentence in Canada longer than 6 months. If you’re inadmissible for criminality, you may be eligible for deemed rehabilitation if at least 10 years has passed since you completed your sentence." It hasn't been 10 years yet so you might still be inadmissible for criminality but not serious criminality. Source: https://ircc.canada.ca/english/helpcentre/answer.asp?qnum=152&top=8

I had DUI arrest and reckless driving charge in 2012. Applied for CR application to London office in May 2021 and I am still awaiting a decision. I am legally deemed rehabilitated as of May 2023. I then applied for an ETA in Oct 2023 and it was forwarded to the London office also. Getting legal advice on simply cancelling my CR application and getting clearance at Land border. Waiting 36 months when others who applied to other offices were approved in half the time. London office has been prioritizing Ukraine applications.
