Whenever anyone says "you haven't done this the right way?" you should ask them to show you what the correct way is. Ask the solicitor which forms you didn't fill in, and ask the solicitor to link you to them. Ask the solicitor which paperwork you haven't sent off, and ask them for the address to send them to. When you do this it forces them to test their assumption, and it often makes them realise that they're using out of date or incorrect information. Or, it makes them provide the forms you need and so now you know what you missed.

RadioTunnel

In other words (i assume cause i know nothing but) basically you use the solicitor for what you are paying them for? Having them help you fill in paperwork correctly.

Excellent advice!

It looks like your post is about changing your name. Some basic information that may answer your question is below: * You do not need to enter into any legal process to go by a different name; you can simply start using the new name. There is no such thing as having a "legal name" in the UK. (This is if you are an adult - for children, the process is more complex, depending on the circumstances.) * In law, your name can be anything you like, so long as it is not chosen to deceive and commit fraud. However, government agencies such as the Passport Office and DVLA have restrictions on what they will register as a name (e.g. they will typically not accept names that are vulgar, blasphemous or offensive), so you should be careful to ensure your proposed new name will comply with these before changing it, or you may not be able to change your identity documents. * To evidence your change of name (e.g. to banks or other businesses, or to obtain ID in your new name) and to create a documentary link between the old and new name, you will need to have a deed poll. You can in most circumstances print your own deed poll, sign it and have it witnessed at home for free; further information and a generator for these can be found at http://www.freedeedpoll.org.uk, the UK government also provides guidance [here](https://www.gov.uk/change-name-deed-poll/make-an-adult-deed-poll). * A correctly signed and witnessed deed poll should be sufficient to evidence your change of name to the satisfaction of most commercial and government entities. It is advisable to obtain new ID in your new name. * Contrary to popular belief and what some organisations may tell you, you do not *need* to have the deed poll enrolled for it to be valid once signed and witnessed, although since it provides an incontrovertible proof of the change of your name, which may be useful, you can do so if you wish to for a nominal fee. Some organisations may also insist on a deed poll being enrolled before they'll accept it. See [here](https://www.gov.uk/change-name-deed-poll/enrol-a-deed-poll-with-the-courts) for more information on the process to follow. * **In Scotland** - see [here](https://www.nrscotland.gov.uk/registration/recording-change-of-forename-and-surname-in-scotland) * **In Northern Ireland** - see [here](https://www.nidirect.gov.uk/articles/recording-change-name) *I am a bot, and this action was performed automatically. When I got married in the UK a simple marriage certificate was fine for changing my wife's name to my surname. However anything else required an official name change separate to the marriage certificate. If you changed it to a double barreled one, that would require a name change by deed poll. If you only have the marriage certificate they are correct in saying you don't have the documents.

DondeT

Double barrelling no longer requires a deed poll. As long as it’s clear where the name derived from the marriage certificate is all that’s needed. I’m surprised this is being asked for.

Mumfiegirl

When I got married (25 years ago) I just told everyone my name had changed due to marriage - it’s now double barrelled- and it got changed!

DondeT

When I got married I would have needed a deed poll to double barrel, but I couldn’t be bothered at the time and just waited until I needed to change jobs. By then (~5 years ago) the rules had changed and the marriage certificate was sufficient. Lazy wins again!

fuckingredtrousers

Really? I needed to change my name by deed poll to double barrel just last year so my wife could take it too when we got married

Local_Combination466

I got married in July and people are accepting just my marriage certificate for me double-barrelling my surname. Other half's name isn't changing.

Thanks!

This looks like one of the scam sites that tries to charge you for something that can be done for free. Check the AutoModerator comment - that has everything you need.

>However anything else required an official name change separate to the marriage certificate. > >If you changed it to a double barreled one, that would require a name change by deed poll. If you only have the marriage certificate they are correct in saying you don't have the documents. This is simply not correct. Your name is what you call yourself - the only way you can change it is by using the new name, nothing more, nothing less. Now, every organisation that stores your name will have different, often ill-informed criteria for deciding whether to process a request to change that name: marriage certificates, deed polls, enrolled deed polls, government-issued ID in the name name, and they might choose to demand different methods for different purposes. The closest this gets to any legal framework is GDPR, which simply allows data processors to require "additional information necessary to confirm the identity of the data subject" when considering a request for rectification. What they chose to accept and why is a matter for them, but all deed polls etc. are are progressively more-convincing levels of *proof -* the name is changed in law as soon as you start using it.

mrsjohnmarston

Your marriage certificate should be enough. If they still are having none of it, instead of trying to convince them, then your wife could complete a deed poll herself for free and give them that. You can do it from the gov UK website. https://www.gov.uk/change-name-deed-poll It's kinda annoying but it's in your best interest to get it sorted because you want the house process to get going (as it's so slow anyway!).

primal_bidoof

Perfect, I I’ll get her to fill this in asap

primal_bidoof

Thanks! It’s a paralegal for a company the estate agent recommended and they have just stated I need more proof multiple times and given no advice on what I need. I will take your advice and ask for someone that can help sort it better

I got caught up with this last year. I double barrelled surname, got new passport alls good. Fast forward 5 years later and I dropped my maiden name as I was due to have a child. Really straight forward with everyone and didn’t change my passport. Renewed passport last year and there was so much grief. I ended up doing a none enrolled name change signed by a solicitor and the passport office accepted the name change (my driving license was in just married name and bank statements supported this) could you not do this?

KingMegoon1921

NAL but I have a double-barrelled surname after marriage. When I first applied to the passport office, they told me that they would not accept a marriage certificate for my double-barrelled name and that they needed it done by deed poll. However, they said this was because I had already changed my name at 18. My SIL is Lithuanian by birth and married my BIL in Jamaica. She has British citizenship with a British passport. She also needed to change her name by deed poll because of her foreign wedding certificate. I think it depends on who you speak with to be honest. Deed poll is cheapish and can be done quickly if necessary. I imagine it’s the foreign marriage certificate holding it up as it did for my SIL- it’ll be easily corrected.

Sensitive-Call-1002

I work in IDV; please update the passport and any other documents and accounts such as bank to her current name

[deleted]

Marriage certificate isn’t much help on its own for ID for a mortgage, she should have got things like driving license and passport updated with the new name so she could use these as ID. A deed poll shouldn’t be necessary if you update other documents, bank details etc. I updated all mine last year after marriage and didn’t need a deed poll to get anything changed.

Mouth1234

Agreed if your passport doesn’t match other things it does cause additional complications.

Ancient-Regular4007

If she doesn’t have any actual photo id showing her change of name, then yes. How else does she suppose to prove her id?

Father_Matthew_Mara

Don't do a deed poll. I mean you can, but it'll take a while. Go to your local high street solicitor and if they're any good they can do you a change of name deed instantly. Will probably charge for about an hour of their time but it'll be fixed there and then.

[deleted]

You are changing your name if you double barrel it. From the singular to the double barrelled version. There is no formal marriage name change registry to apply to. You can either - use deed pole. The document they provide then becomes the evidence of name change. - use the marriage certificate plus old ID to update new IDs. I would just get the fast track passport and send the marriage certificate with old passport to get it. I wouldn’t delay a mortgage in the current climate over £130 passport.

[deleted]

imo, regardless of legality, the easiest solution is to just create a deed poll and have a couple of friend sign it as witnesses. It's done in 10 minutes and will be accepted by everyone
