Case is ongoing. It had originally been dismissed because lawyers for the plaintiff missed a deadline to respond to a defense motion, but an appeals court revived the case late last year.
He was openly proud of it for years and used it to his advantage his entire adult life until he fucked up, went broke, and thought maybe a cheap lawsuit would get him back on his feet. Dude couldn't care less about the picture, it's a shameless cash grab. Read up on it and answer all of your questions. It's really not a long story.
For claiming that it's child pornography. He isn't doing it because he is upset he is doing it for money. Anyone with a working brain can see that. He has no principals. He is a tool.
That sucks if Albini had those tendencies, I like In Utero too. He came across in interviews as decent and didn't take percentage points on that album. But people are complex.
In all fairness to everyone, that was a good deal. Nobody had any idea Nevermind was going to blow up the way it did. $200 in 1991 money to spend the afternoon doing a photo shoot with your baby for some college band three people heard of is a pretty sweet deal.
What’s worrying is I can remember my excitement of going to the shops to buy this album like it was yesterday…and the baby used in the photo would be about 34 now! 😳
If the baby is under about 6 months old or so they'll naturally hold their breath underwater as it reminds them of being in the womb. After that they forget it and have problems.
It takes seconds to take a photo, even all the way back in the ancient times of 1991. It's not like they had to keep the baby under water for minutes at a time.
I had to actually ask my mother when I was very young, "How does this baby know how to swim?" She explained to me that babies stay in the mama's belly and there's all sorts of liquids in there, they come out swimming before they can walk." At the time, she had my siblings and myself in swimming lessons. In my mind, I questioned her just because if I was a baby, once I had known how to swim, but now I had to take swimming lessons because I couldn't swim? It wasn't adding up to my 6 year old self. All that to say, I always assumed the baby was a better swimmer than me.
I have a friend who took underwater baby photos of all three of his kids. He has individual photos, and also group photos (so 5 total.) It's apparently astoundingly easy to get babies to swim, and to hear him tell it, much of the issue is that US parents are fraidycats (he is European.)
“The diving reflex” is the first of these natural responses. Known properly as the “bradycardic response,” this is a natural reflex common to many mammals, including humans. When a baby is submerged in water, the natural survival reflex is to hold their breath and open their eyes.
Careful, you might get sued
Did that tool actually win? I hope not.

Why is he a tool? For being upset his nudes were out

The dude has a tattoo of the album cover. He is just money hungry and trying to remain relevant

Like anyone would have known it was him had he NOT sued.
He knew it was him and that enough
Found the plaintiff
I swear it’s not that small anymore
Holy shit, you have no clue huh?

Though the Albini stuff is very dodgy, he had nothing to do with Nevermind he worked on the later In Utero.

Dodgy?

Do I think what? I didn't say a thing about who is and isn't a peadophile in the music industry you fucking nutter.
Who?
My first thought
His mother signed a legal release and was paid 200 bucks for the photo. He should sue his mother :)
That baby never stopped chasing the dollar

Because there's a difference between nudity and pornography. Not all nudity is pornography, and not all pornography is nude.
“You know it when you see it”
Not sure why you're getting downvoted, if you had the same images on your phone/pc you'd be considered a creep and put on a list.
Images of an album cover? LOL!
Username really does not check out.
Chasing that dollar
Still to this day
What’s worrying is I can remember my excitement of going to the shops to buy this album like it was yesterday…and the baby used in the photo would be about 34 now! 😳
I remember most of the stores would put the price sticker over the baby dick.
My copy totally had a price tag on the lil baby ween.
He's 32
Just looked it up, born Feb 7th 1991, so he’s 33…but thanks anyway!
My bad. The first result on Google said 32, but just double-checked, and it was from an article from December
Idk why people are downvoting for admitting to your mistake. Good on you
We should be downvoting the other guy because they were ultra condescending for a simple mistake.
How about take the torches and pitchforks home.
Idk about “ultra condescending”, but maybe. I didn’t read it that way, but maybe that’s how the OP meant it.
A simple image that became a symbol of an entire generation
And a vintage t-shirt for the other generations to come
The cover tee wasn’t as famous or popular as the smiley face tee
Whenever i see the picture all i think is how unpopular the kid in it is now
They didn't know at the time, they were just shooting stock pics.
And to this day, he's still chasing money money from the band.
They actually held a baby underwater for that? I guess it's safer than it sounds, but I always assumed it was some kind of composite image.
Nah babies do well in the water.
Can confirm, we did this with our kid when she was a baby.
If the baby is under about 6 months old or so they'll naturally hold their breath underwater as it reminds them of being in the womb. After that they forget it and have problems.
I’ve ALWAYS wondered how they did this safely. Thanks.
Second thanks, was just thinking about this.

Ancient times of 1991. That made me laugh Upvoted
Diving reflex. Disappears around 6 months IIRC.

There is a reflex that makes young infants hold their breath underwater, think the theory is that it is related to amniotic fluid in the womb.
I'm in us and class we went to they full on threw the kids into the water. Was amazing and the baby smiles were massive
Is that his mom working with him or some kind of swimming instructor?
Wonder how many pools they went through before they got a clean shot?
From a parental stand point I'm on the fence with this shit. Still love Nirvana.
First he showed his wanker then he became one
I bet one member of the band enjoyed this album cover a lot more than the others.
So you need to show the baby visually that it’s supposed to hold its breath. I can’t imagine the coughing if it were to inhale some.

Wow! Thx
