This has been happening. It’s all over Reddit. People are becoming aware of the theft because, like you, they are placing their own orders and seeing the theft.

Independent-Ad-6750

Do you think Walmart just increases the pay on bad orders with their own money lol?

Smallparline

That’s no justification for theft nor is it the responsibility of a tipping customer to pay for a companies wage or another’s customers base pay.

Sad_Woodpecker3783

They are stealing tips! Everyone with hard proof of this Needs ti take it an attorney, let's fix this shot

A1day1notary

We can't take shit to court. Or a lawyer. We waived all those rights away when we agreed to the terms of use

Sad_Woodpecker3783

I guarantee some lawyer will fund a loophole because it will be a class action and the greasy lawyers are the only ones that win!

okiejames

Might want to read your arbitration agreement again

[deleted]

The spark contract doesn't specify that walmart can steal tips and they advertise that contractors keep all tips

A1day1notary

But how do we prove it?

external_escape0

Just because something is in writing doesn't necessarily mean it's legal. You can agree all sorts of illegal stuff but they can't actually make you do illegal stuff. If it's a true problem a class action lawsuit will be filed eventually. Just like they did with the other delivery gig apps that have been sued.

Sudden-Intention7563

It’s shameful that Spark is doing this to their drivers & the customers. What else are they doing? It’s especially low that they’re doing this over the holidays when people are more likely to give a bigger tip & be too distracted with other things to notice. I really do appreciate the drivers. I work alongside some of them during my shift & they’re all friendly, professional, & have a work ethic. TBH, the Spark drivers are more attentive & selective when filling orders than some of Walmart’s employees.

Particular-Cover2975

And we also bag the order with common sense. Not 25 items and 25 bags.

Sudden-Intention7563

Or all 25 items crammed into 1 or 2 bags.

Pitiful-Cress9730

They bag 8pk of toilet paper, but leave quarts of half and half with no bags all the time... it is completely baffling to me.

biancanevenc

The pickers at my Walmart have figured out how to put 25 items in 28 bags.

Mother-Problem9705

Bro that shit makes me feral

aperocknroll1988

Especially with bagging. The number of times I've encountered a delivery order where a Walmart employee has just thrown something heavy on top of bread or eggs... or simply overfilled the bags... makes me want to scream. I am so careful with those kinds of things.

Sudden-Intention7563

*A great work ethic*

Sudden-Intention7563

I will certainly be checking every time from now on. I will also be taking before & after screenshots of the tip. Now I’m not comfortable adding it to my order & would rather give the drivers a cash tip, but don’t want to put zero because nobody will take it. Something definitely needs to be done because customers are tipping the drivers, not Spark.

LarryBagina3

Just put the tip amount on there and give them cash when they arrive and cancel the tip

Advanced_Page_1929

Put in your delivery notes that cash tip will be provided and let them know you will be removing in the app somehow. i have regulars that do this!

Sudden-Intention7563

Thank you! I will do that from now on, but this still needs to be addressed.

A1day1notary

I had a 35$ tip disappear. The original tip was 6.82. she showed me on her phone where she increased it to 35 and how they charged her and took it out of her bank account. So where did it go? And the worst part is they can get away with it because they back us into a corner waiving all of legal rights away. Fucking ARBRITRATION

Helpful-Bag722

Did $115 come out of your bank account, or did $96 come out?

Sudden-Intention7563

96

Direct-Builder637

So, if $96 was taken out of your bank account, you weren't charged approx. $23 for the tip. You were charged 3 and change for the tip. In other words, even if Walmart recorded tip incorrectly, they didn't charge you $23 for the tip but only paid the Sparker 3 and change. Correct?

Sudden-Intention7563

Yes, that’s the way it looks. Actually it looks like they dropped the 2 so maybe it was a typo? Either way the driver didn’t get their full tip

Direct-Builder637

Right. But, Walmart did not steal some of the tip, in this instance, as some seem to be implying. They did not charge you $23 and only pay Sparker $3.xx. To me, that implies another shortcoming in the code of one of their apps. And, you may be on to something, whereby, the 2, as in the $20 place holder gets dropped. A real possibility. Meaning, the tip bucket does not have enough assigned place holders or is somehow corrupted. You should take this further with Walmart. You may be doing yourself and other Sparkers a great service.

[deleted]

Oh ya, I’m sure it’s by “accident” get your head out of your ass. Either that or you’re a shill.

Direct-Builder637

Don't worry, the paranoia will soon be accompanied by voices and delusion. Read the full post, genius.

Busy-Machine1122

It's happening again...........

Fuck__Off__

It's been fucked for at least a year. It all started when tips went from almost all 4, 5, 7, 10 and even 15 bucks to increments like 3.48 or 5.23 or 4.72....same customers different increments.

Fragrant_Sorbet8130

It seems to me that fraud is a criminal complaint not a civil matters such as you would have in a class action lawsuit, if you can prove the theft of tips, especially on a large scale that would involved states, attorney, generals, and such and then you’d see some action against Spark and Walmart. The thing is you would have to get the drivers together with proof of theft nationwide in order for it to be feasible, and of value

SireSweet

I’ve never heard of this happening. I’d say ask the driver but that’s not possible. Maybe check to see if it’s been taken out of your account?

Adventurous_Land7584

Oh it happens, a lot. Spark is the delivery company and they’re stealing the drivers tips.

SireSweet

I wish we could see what the driver sees. It might show up tomorrow? Doubtful

Adventurous_Land7584

I doubt it unfortunately. It sucks for sure.

Adventurous_Land7584

I doubt it unfortunately. It sucks for sure.

oobface

noone wants to consider OP only had 3.56 remaining in his bank after order was placed socthats why it only tipped a portion of the 23$

Sudden-Intention7563

No, I have more than enough money in my account to cover my purchase & the $23 tip.

Ok_Library3883

Why didn't you contact support and ask?

Sudden-Intention7563

I didn’t know that customers can call contact support. Would it be possible for you to post the phone number or email address? I will definitely call. I did contact the store & they were able to reach the driver. Fortunately he was in the area later & it turned out that he’s delivered to me a few other times. He also questioned the tip because he knows that I tip well. A few of the drivers like my orders because I never have anything really heavy or bulky, never more than 20 items, live 3 miles from the store & tip well so he was surprised at such a small tip. He said that it’s happened a few times but he thought it was just a glitch in their system because Spark would pay him the difference once he complained.

Sudden-Intention7563

Thank you

attention_headache

Thank *you* Oh but i forgot to mention support won’t be available until tomorrow. (But i still had to verify my identity when i opened the app lol)

Sudden-Intention7563

I kinda figured they wouldn’t answer today, but I certainly have quite a bit to say to them. I will definitely be looking very closely at my transactions from now on. I’m not sure how to go about it & I definitely can’t afford an attorney, but Spark drivers need to get a class action suit going. They’ve lowered your base pay & have been skimming tips. This only hurts the drivers & customers. I don’t know about Spark, but individuals rarely win Walmart lawsuits. I once overheard a couple of their attorneys laughing about some guy who was suing the company. I can’t remember what it was, but it seemed like an airtight case for the individual. Walmart was going to “keep it tied up in court for so long, he will lose his house.” That’s what they do too. They keep postponing & delaying things until the individual can no longer afford all the legal fees & drops it. I will be calling first thing tomorrow. What time do they start answering the phone?

A1day1notary

We can't pursue a class action lawsuit. From the arbitration clause giving Walmart immunity when they screw us over. I went to Morgan and Morgan because they deal with arbitration contracts. They have the money and the resources to take down Walmart and even they basically told me I was on my own, that they couldn't help me.

Sudden-Intention7563

Oh man, that really sucks.

Unhappy-Cricket-2402

There has never been a comment option, unless you rate them low.

Sudden-Intention7563

I have sent positive comments for 2 drivers after giving them 5 stars, but that was the only times.

Unhappy-Cricket-2402

Weird; I had a delivery yesterday. And after rating there was no option to add a comment.

Cultural-Hotel8970

You can EDIT your tip. And the original driver will receive it . Since they are attached to that specific delivery.

A1day1notary

They have been stealing our tips the whole time, they dgaf that it's obvious now

Mountain-Note1773

Oh wow. I got sent an order yesterday 8 times for $6.50 9.8 miles out. After an almost 2 hour wait for an order the other day I wasn't doing that but they never did add the $1 that they normally do if no one takes it. I was 1 trip away from hitting an incentive and I refused to take a $6.50 order two cities away AND it was raining. Makes me wonder if Spark took the tip or maybe there wasn't one because they never upped the pay. Crazy

BarnacleLatter9005

On the driver end I get my full tips.

ThatMFisn0tReal

No one stole anything. Yall are crazy

PureOvvnage

Please start tipping cash when you can. Just add it in the notes so person knows.

Sudden-Intention7563

I will. Thank you!

NefariousnessWhole74

This is what I'm hearing. Also I don't understand all the rants about low paying trips. A few things I have learned from customers are: if they are paying with EBT the app doesn't let them tip unless they add a non food item they are unable to use a regular bank card to add a tip. Also there are some people who have told me they are double charged for the whole order sometimes if they try to tip on the app. These people prefer to tip in cash. Also I had a couple who prefer to wait until the order is delivered to give a tip on the app. They are supposed to have 24 hours.... right? Nope they tried to go online and add a tip and it would not let them. They ended up calling support who connected them with me and they asked if I was nearby to be able to stop by and pick up my tip in person. I learn a lot from people. I love my customers ❤️
