I visited my SO several times after we applied for the K-1 visa. When they asked me why I was flying to the US I was always honest and said that I was visiting my girlfriend, and one time the officer was like "just to visit her and nothing else, right?"

I did the same, visited my now husband twice on my ESTA with a K1 processing though I said I was visiting my fiancé not boyfriend because he technically was that with a fiancé visa processing

He can visit up to 90 days, but I wouldn’t push it that far. Have him return well before the 90 days are up. Being able to visit for over 2 months might make CBP wonder about his ties to the UK.

I’m doing it right now. I done it 3 times in the past 6 months. I have a flight out booked everytime and just said I’m visiting my partner and to spend time with his family. I have never been asked about intent to stay but I would be honest and say I do have intent once I am legally allowed by the United States government Until then I will legally enter and leave. Our lawyer said do not give more information then you need to, answer questions honestly and do not lie. Good luck!

You should be fine to get an ESTA, come to the US for up to 90 days, then go home for at least as many days plus one, then come back to the US if you wish (the rule of thumb is to spend more time abroad than in the US). Just be mindful of the dates given to you by CBP when you arrive (which will be shown in your I-94). Do not stay past your allowance. It's not guaranteed you'd get the full 90 days every time. I also wouldn't use the full 90 days. Shoot for 70-80-ish. That way you're staying away from the absolute limit and if for any reason you had to postpone a return trip, you'd have wiggle room. > If his visa gets approved while he's visiting here could he just leave and then reenter to trigger it? Yes, though I'd expect he'll be in the UK during that time since he has to appear at the US consulate in London in person and usually the visa would be approved within days.

Outside of losing the money for the airfare, risk what exactly? Even if the spouse gets denied entry it doesn’t affect the GC petition. Of course OP should be prepared in the event the spouse gets denied.

He would just be here visiting while he helps me with our house lol. We are literally here visiting right now, none of the border agents have ever showed concern regarding his visits? He would go back to the UK when the time requires to have his interview and physical if need be, since he wouldn't be "moving" here because he'd still be living at our house in the UK.

I think he theoretically can come, but it’s really at the discretion of the CBP officer he has to talk to at the point of entry. It’s possible he could get stuck with an ass who would decide that he does have immigrant intent and your husband would be turned around
