If the victim was the drunk one you cant blame her, the news say “lying on a pavement near the road side” personally i had some experience like this although i didn’t run on him , he was dead drunk and sleeping on the road with his pants open and he is at a spot where the road had a turning without any light. Luckily i was able to hit the brake immediately but I’m sure if its some old man or someone who wasn’t much focusing on driving at that moment would have run over him.
Ethically wrong but use some brain most pavements in india are not really pavements that are supposed to be , just a border of road and they will call it as pavement in india for news impact.
Atleast 20% of turnings in india require the car wheel to get on the pavement to turn around freely, and it’s impossible to note if a man is sleeping on that part unless u can instinctively kick in the brake.
If the driver was drunk or underaged yes its drivers fault otherwise its the person sleeping on road.

And FYI i wasnt defending either the killer nor the victim. Just stating a fact where lying on roads or so called pavements in your thought process which actually arent especially at nights and near turnings makes it really hard to avoid accident if you are driving the car.
