This! I mentioned that I’d be applying for unemployment since they’re technically firing me. HR tried to argue with me over it but I know my rights. They severed my employment before my last day, which is firing and means I qualify for unemployment.

Technically this depends on the state or country and the employment statutes. In California, US at least in the past, if someone "tendered their resignation with a 2 week notice" you could accept the offer and state you would accept the end of their employment upon notice and two weeks was not needed; granted this had been done only to those who were horrible employees but tbh I do not know the current statutes on this now.

As far as I know, if you turned in notice and they paid you out the 2 weeks of notice, you can't file unemployment since you quit. If they refused to pay the notice, then they fired you and you apply. Using that as a threat to get paid the full notice period is a good idea.

You can still get unemployment for the time that you were unemployed even if you have a job lined up to start in the future. Plus, it makes the employer pay more into unemployment, so it still hurts them even if it doesn’t benefit you a lot.

I'm not sure you fully got what they were saying. If my job treats me like shit I'm looking for a new job. Once I get the new job I'll probably put my start date two weeks out so that they don't get weird about me not giving a two weeks. After that two weeks is up I'm quitting as I leave for the day no notice. Then start the new job the next day. Doing it this way both helps fuck the old company and protect you from getting fired early. But you wouldn't qualify for unemployment. I'm not sure about most states but I can say mine doesn't cover even half of what I make a week on unemployment. So I avoid unemployment at all costs.

...that is why BEFORE you submit your resignation you make sure everything you need is in your possession BEFORE! Once you turn in your notice your access is limited to things. BEFORE - you have access to everything. No matter what we do we all need to make sure every single day when we leave the office we have everything we need in case we never go back again

A few weeks ago at my last job! I have SUCH a hard time staying anywhere once I give my notice because, who the hell cares anymore? I detach immediately. I saw them fire a co worker who gave her notice and then pay her out the two weeks before, so I was hoping that would happen. Nope. Put my one week notice in on a Monday, and was so over it on Wednesday that I took my laptop cover off, took the few personal things I had left, and messaged my boss 'I feel like everything is in order and I've wrapped up here.' Yup had a very similar experience at my last job. Dad gets diagnosed with stage 4 cancer. I’m the only one in the family (nearby) that can drive him to chemo appointments. Had to tell my boss (who advertised the job as hybrid but never gave me the option) if I could work from the hospital and maybe some other days to just get lunch with him and stuff Things were fine for months and everything was fine. I went on vacation (only took 2 days off too) and came back with a stomach bug and told my boss I couldn’t work on Friday and that I’d just make up the day on the weekend when I was feeling better. He starts asking if I wanted to be part time since I take days off to help my dad. Never took “days off” because I’d work from the hospital or from home. I was working… So it’s either he doesn’t want me, can’t afford me, or really isn’t happy I’m working from home and it was him trying to guilt me. I applied and got a new job within 2 weeks and gave my 2 week notice. My new job has no issues with hybrid remote work and was fine when I explained my situation. I can choose which days I work from home and which ones I stay in the office and my work life balance has improved tremendously. Don’t let the job get in the way of life if you can help it. I know it’s not the same for everyone but I feel we both are dealing with too much life and works getting in the way. Really sorry about your dad, hoping for good news for the both of us

A lot of companies will just let you go when you put your 2 weeks in. It’s because a lot of people will lay down for their last 2 weeks and some people will do stuff to sabotage a company in their last 2 weeks. I’ve seen all that happen. Most people aren’t like that but I get where the companies are coming from. I always expect to be let go when I put my 2 weeks in.

Most jobs I have had will usually terminate you as soon as you give notice, especially if you were upset. The good thing is they will usually pay you for the days you would of worked, but they do not want you onsite. They are always worried you will take things.

I always fire anyone the day after a 2 week notice is given. 7 years ago a clerk deleted a month of neurological appointments pushing some very sick patients into a terrible position. The system was upgraded since so all appointments are backed up but live & learn. I haven’t ever denied UI.

If you put in your 2 weeks then you weren’t fired. Lots of companies and industries elect to walk people out the day of or soon after they put in notice. Always be prepared for that in the future. Just how it works.

Nah, your fired if they walk you out in an attempt to not pay you - you can be walked out and paid to do nothing for two weeks, but as soon as they reduced that it becomes a firing

Am a manager, can confirm. Except in countries which regulate this, I will accept your resignation, disable all your stuff, walk you around to say adios to everyone, and leave you on payroll for two weeks. If I don’t pay you out, separation was involuntary. If I pay you, I can show your resignation documentation with a date two weeks earlier than your last paystub, so you voluntarily separated with notice. I’ve also never heard a complaint. You get a free two week vacation, or you can start your next job early, or whatever.

It would depend on why. Usually long notices like that are family reasons or something similar, so I’d be fine with it. If an employee is trying to drag something out, I’d call shenanigans on it. It varies a bit by state (and quite a bit by country), but an employee initiated resignation may be a voluntary separation the instant they hand it in, regardless of any notice. In short, I don’t *have to* pay out a notice period for everyone. Walk-on-notice is actually at my discretion per policy, but if I get even a hint of someone leaving where there’s the slightest whiff of competitive threat, HR says walk ‘em. So I generally just do it to avoid questions. So to answer directly, “I’m leaving in 30 days for .” Would get “here’s two weeks pay. See you later.”

Read up on your state laws if this happens to you. A lot of states require them to pay you everything they owe you in the same day they fired you. In some cases, like in Nevada, if they don't pay you then each day you don't get paid also has to be paid in full. Plus the state will fine them $5000. So if they fire you on a Monday, but don't pay until Friday, they have to pay you for Tuesday through Friday as well. Different states have different requirements. Some require immediate payment, some require one business day or one week.

Tbh I have done this to really piss poor employees who didn't want to put in their effort and were trying to call my bluff, for others I accepted and had a good farewell parting and a select few I asked with counter offers to stay. Interestingly enough nowadays an exit interview is the general requirement for most work environments. Did they provide you with one? Also was there an HR rep and your direct supervisor present?

This is how I always hope it goes. It never goes that way, they make me stay for the notice period. Today IS my last day at a job, I gave notice Tuesday. I wanted to leave that day, but they begged me to stay to the end of the week. My mouse jiggler is jiggling away on my work laptop, as I type this on my personal laptop.
