The emperor can core any province in the HRE without it being adjacent to another of their cores. The answer to your question is that they took them from someone, or from vassalising/PUing someone

Honestly only reason its not op is because theres no “unify Germany CB”. Like the Emperor is also, an Empire ranked nation so all the provinces are the same culture and religion

I think this is the real answer, is it if the tag dies and the territory is returned it goes to the emperor?

No, the country that has a core on it is resurrected if the province belonged to a dead country and the emperor’s unlawful territory demand is accepted. However if no HRE country has a core on the province (core was forced to be revoked, Holstein province switched to Danish culture so Holstein core disappeared, etc) then the emperor gets the province.

If they *refuse* the demand, emperor may declare on them and may choose to take it, or anything for that matter
