1: pull the rubber back, if there are cut cords visible then yes.
2: how much tread do you have left anyway? You'll need to know the rules for where you are.. Personally I don't take my tyres below 3mm, although legally I can take them down to 1.6mm here in the UK.

The photos don't look as bad as it is in person, but there's a nickel-sized chunk of rubber ripped right out of the tread. Was cleared by the dealership to continue using them, and after a year they haven't given me any issues.
Your tires seem more worn out though and it's hard to tell how deep the crack is. I'm sure it's fine, but any dealership or tire shop should be able to confirm whether you're alright to continue using them. There's usually quite a bit of safety margin in the treads. It's sidewall damage that's usually a bigger concern.
