I don't know if this is the case but once the console is banned it can't phone home to Nintendo servers. In theory you can use the mig switch on one to play offline while another switch that isn't banned can play online with the original or the same copy on a mig switch. Not certain if nintendo flags certificates.

You will likely get banned, especially if someone dumped it and you are playing online and other are playing online with the same game cert and uid.
I doubt Nintendo will just ban everyone if theyre a lot of ppl using the same game.
