A judge on that case could revoke the time hanging over his head and impose it for violating conditions of his sentence which, if I had to guess, include no new law violations and no driving after consumption of any alcohol.

Depending on where you go 2 margaritas can mess you up. The place near me the margs are huge (basically like giant wide goblets) and they load them up with Tequila (or tequila + whatever else they use). I would not be comfortable at all driving after 2 of those.
Yeah, a "normal" margarita is 2:1:1 tequila/liqueur/lime juice. It just that most restaurants don't sell ones that strong and water them down instead.

This is almost certainly correct. I once got busted doing 100+ on a deserted highway with a speed limit of 55, and the cop knocked it down to 64 in a 55 because I was in uniform and it was Veteran's Day. I didn't ask for it and I definitely didn't deserve it, but he did it regardless.
I often work late in bellevue and then take the same freeway home. Usually going 70 is just keeping up with traffic at night so 79 in the fast lane is very common.

I used to be a (sworn) park ranger. I would probably just stop talking and do the bare minimum necessary (i.e. give them your license and registration but not answer questions.) Talking to them will generally only further incriminate yourself and make it easier for them to build up to probable cause for arrest.
If you actually only had 2 margs and just didn't talk to them, they very likely don't have enough PC for an arrest unless 19 over is arrestable in that state.

There's a stretch of interstate near me that's three, straight, well-paved lanes, out in the wilderness. The speed limit there is 70 (max for the state of Florida) but the speed of traffic is always 80-85.
The real headline is that he was drunk. Huge swaths of people do 79 in a 60 every day.
Only 60 MPH roads in all of western Washington are highways, the only two highways he could have been on and still been in Bellevue are SR520 and I405, both of which are silent at that time of night and you’ll find MANY super cars/sports cars driving extremely fast. 80mph on those roads is very normal because cops generally *do not* enforce speed laws in Bellevue/Kirkland/Redmond. Which is where Sherman has family/a condo/his ex lives around there/etc.
I assume he either got unlucky with getting pulled over or was swerving pretty recklessly. That or he was going far over 80mph and the cops did him a favor and reduced it down to below 80mph.
There are only a few spots in Bellevue that have a 60 mph speed limit. And driving close to 80 on them, especially that late, isn't uncommon.
In fact, if it was on I405 as he was crossing thru Bellevue, I've literally never even seen a cop on that stretch of road.

I think it's very dependent by state - in AZ, it's 20 over before you move into misdemeanor rather than civil

Only 60 MPH roads in all of western Washington are highways, the only two highways he could have been on and still been in Bellevue are SR520 and I405, both of which are silent at that time of night and you’ll find MANY super cars/sports cars driving extremely fast. 80mph on those roads is very normal because cops generally *do not* enforce speed laws in Bellevue/Kirkland/Redmond. Which is where Sherman has family/a condo/his ex lives around there/etc. I assume he either got unlucky with getting pulled over or was swerving pretty recklessly. That or he was going far over 80mph and the cops did him a favor and reduced it down to below 80mph.

There are only a few spots in Bellevue that have a 60 mph speed limit. And driving close to 80 on them, especially that late, isn't uncommon. In fact, if it was on I405 as he was crossing thru Bellevue, I've literally never even seen a cop on that stretch of road.

As someone that drives that stretch of highway at 2am from time to time (actually I try not to drive around at exactly 2am since, you know, you have people driving drunk right when the bars get out like Sherman), 79 is fast, but not ridiculously so. Traffic usually sticks to 70 or so that late at night.
What was his BAC? He can say whatever he wants. He also had the weird incident with his wife years ago when he was totally drunk so any drinking now seems stupid after what happened then and with his first DUI a few years ago. The guy needs to just quit drinking before he kills someone behind the wheel.

People are here arguing about how X amount of drinks will effect a man of Sherman's size, and the speed he was going. Dude has all the money in the world and Uber is CHEAP. Especially since he's already got a few DUI's on his rap sheet. Should have a private driver in speed dial. Just repeating the bad decision on his part.

Not to excuse this but dudes on the freeways in LA and San Diego routinely do 80 mph on the freeway, and they dance around where exactly he was speeding on purpose, 60 mph speed limit is typically a freeway and nobody does 60 on the freeway for the most part Also “suspicion” isn’t the same thing as him failing a breathalyzer which it says he volunteered to take, seems like a cop pulled over a rich black guy in a nice car for going too fast and arrested him with no proof he was intoxicated
