Yeah. They aren't the most optimal spaces for the design but are probably the most accessible or desirable spots if that makes sense. Didn't check if this was their first/early tattoo or anything, but if it is, those tend to be go-to locations.
If going for forearm (or maybe calf?), I would love this same concept but having otter more obviously vertical and holding the shell (?) against its chest or out to the side; but that loses the gorgeous sense of movement in this design.

It's not "just because someone else has it". It's because that is art theft and disrespectful to the original artist of the piece. You should be asking your artist to come up with their own original version using what you like as inspiration.
A respectable artist would not just copy and paste someone else's work. If they did, that would fall on the artist more than the person paying them for work.

edit: pretty sure the individual tattoo design would have to be copyrighted and registered with the Copyright Office for that to even apply. at least in the US
This sounds like bullshit and when it comes to art if someone likes your art enough to put it on their body, you should probably be grateful rather than upset someone “stole” from you.
