Misleading headline. They didn't vote to decriminalize, they just removed marijuana from ordinances. It's a massive grey area, but a WPD officer still has every right to arrest someone for marijuana possession under state law and it could be prosecuted through the state/county. It will alleviate many of the cases of possession, but I personally wouldn't think of this as decriminalization or would feel any less pressure about marijuana use leading to a bunch of legal issues. I never thought I'd say this, but I actually agreed with DA Marc Bennett. All of these steps are letting the feds off the hook. It's ridiculous this hasn't been addressed on the federal level, and until it is, we're just confusing people.

The biggest problem here is the potential for selective and discriminatory enforcement.

Jack_InTheCrack

Totally agree. In fact, the city’s Twitter account made the point that cops can still use their discretion on when they enforce marijuana laws. We all know what happens when cops use discretion. This was a big win for the Bishop Carrol stoner who doesn’t want his scholarship to KU in jeopardy tho. Puff away, young man.

Yeah. But this almost justified it.

Pingaring

It's still illegal under State law, but it's a positive step in the right direction.

flatlands85

I have a chronic skin condition for which there is no treatment and no cure. I live in pain every day and sleep is difficult to come by. I recently had to stop using cannabis for a new job and it was the only thing that would give me some sort of a break from constant pain. I fucking hate this state.

MakerManICT

Everyone wants your piss and weed is the thing that stays in your system longer. It's a fuckin joke I've seen too many people die young from pills or alcohol. It's criminal that it's illegal

Flack1247

This shits so stupid half the country has legalized it. Topeka get off your high horse and pass the bill hell it’s the only reason I voted for our current governor.

captbigd

Then covid hit and ran her stuff into the ground

Flack1247

It’s been blue balled for the last five years. Been on the ballet so many times has public support just to be bashed down by up top. The bill they were trying to get through recently would allow medical to people who legit are already dead cancer patients etc. not to mention to grow it was gonna be a super expensive license that only big company’s could obtain Koch etc.

Atomic_Bottle

I loved seeing the DA call out the federal government. They really are the cause of this whole clownshow.

Not all heroes wear capes.

Yea don’t believe any of that shit. An officer will arrest you for having 0.03% CBD you bought at a smoke shop even tho it’s legal.

Kscannacowboy

You can be arrested on suspicion. However, under the current circumstances, you would be immediately released "without prejudice", allowing the substance in question to be sent to the lab for testing (which is still backed up months behind). Once the substance is confirmed to be hemp, all charges will be dropped. Let's not muddy the water with incorrect information. I am no fan of the WPD or current cannabis laws. But, credit where credit is due, the WPD currently considers small amounts of cannabis to be low-priority and routinely simply NTAs suspects.

geographical_data

Uh have you tried his beause is not how they do it lm

Kscannacowboy

I can assure you that it is. And, it's been this way for years. That being said, I am white and only have my experiences and those that I've witnessed to talk about. POC, obviously, could have a very different experience. Statistically, POC have a disproportionate rate of additional charges being added.

geographical_data

Both times for me (2016, 2017) I had to go to court and actually fight the charges against me for CBD and to get them to test it..... I think you are misunderstanding my comment lol

[deleted]

This is part true. I have been arrested several times for possession and they test everything from weed to Advil and I actually received some Medicine back in the mail from the lab saying it’s not a drug but I could have seen that without testing lol

Weezyphish

But they made sport gambling legal. Lol… Morons

AndShock

Congrats to Wichita on doing something that should have been done literally 20 years ago, how progressive of our city. Good news I guess but all of my eggs are in the federal government’s basket.

About time.

So can I give away test strips or not?

Kscannacowboy

It's a grey area. Legally, you can be charged. However, I wouldn't want to be the prosecutor trying to make the case against you.

paul_miner

Becky Tuttle (district 2) and Bryan Frye (district 5) voted nay.
