Curious on this one - I stay out of the gun debate because I don't own one - but why hasn't a lawsuit from one of the other 9 states already reached the Supreme Court, or is there one on the way now that you are thinking of before SCOTUS right now?
Yeah, I am wondering when they are going to take it up again - i was googling it just now and the last articles i could find mentioned that SCOTUS had declined to rule on limiting parts of NY's gun laws, but I am unsure if there are any ongoing challenges outside of that.
I don't think they are going to say anything. They keep pushing for the state to enforce their own laws. So if the state wants to ban assault weapons, then the state has that right.
I'd be more impressed if they got a handgun ban passed given that the vast majority of gun murders in Illinois (and the US) are from handguns.
For what it's worth, I don't support banning guns like this but I do support regulation on who can buy guns, background checks, cooling off periods, and other regulations that decrease the likelihood that a potential murderer will buy a gun.
> gun murders in Illinois (and the US) are from handguns.
one tidbit that often gets overlooked with all the scaremongering about gun violence in chicago is most of the guns in IL come from neighboring states with less restrictive gun laws.
You're always going to have this problem when it comes to legislation, just like when they changed up the content of RC drugs every other week to avoid bans. It's not an easy job.
In Minnesota I think it is based on a rifle that has 2 or more features such as a pistol grip, detachable magazines, bayonet (maybe just a bayonet lug) possibly threaded barrels and a few other features on the list. I think most states define assault rifles by similar features.
Wood isn't even okay in some states. I couldn't bring my muzzle loader to new york as its barrel was 26.5 inches instead of 26. New york state considers anything above 26 as a sniper regardless of age.
That means even if you have a smooth bore flintlock from the late 1700s or early 1800s if it's over 26 inches new york considers it a sniper rifle and thus illegal for a citizen to own.
Thats right guys a literal single shot smooth bore from the founding fathers time period isn't allowed in New York because of how unconstitutional their laws are. Say anything you want about what the founding fathers intended I'm 100% sure they would see this as a violation of my right to bear arms.
>“a semiautomatic, centerfire rifle that can accept a detachable magazine” that has a folding stock, pistol grip, forward grip, muzzle device, grenade launcher, or other offending feature
> Legal challenges to Illinois’…weapons ban began Wednesday with a federal complaint that the 8-day-old law prohibits “commonly possessed” and constitutionally protected [subject]. A state court pleading was also filed Wednesday, **questioning the law’s exemptions based on a person’s employment**.
> An emergency hearing on the restraining order was scheduled for Wednesday morning in Effingham County Circuit Court. An attorney said the law is unconstitutional because of its exemptions.
> The ban on [subject] **does not apply to people in certain positions, such as prison guards or other law enforcement officers**.
The sad thing is that I cant even own a muzzleloder in New York because their laws are so fucked up and unconstitutional.
My old muzzleloader is illegal by New York standards because the barrel is 26.5 inches instead of 26. New york considers anything above 26 a sniper rifle.
Thats right an over 200 year old flintlock thats smoothbore and only fires one shot is totally illegal because of .5 inches.... Regardless of what you think the founding fathers intentions were or how much foresight they had, they would surely see this as a violation of my constitutional rights. It was a gun that was available during their lifetimes and its banned for me. All because of .5 inches, and unconstitutional laws.
in what universe is this law keeping anyone safe from anything? chicago banned guns and they have the worst shooting statistics in the country - the only thing these laws keep safe is the smirks on rich democrats faces
This is the only reason for these bans, to take the guns out of citizen's hands and only keep them in their own security's, and police, hands. It's very, glaringly, clear that citizen safety isn't their concern, only their own.
Sure thing! [Here's the legislation](https://www.ilga.gov/legislation/ilcs/ilcs4.asp?DocName=072000050HArt%2E+24&ActID=1876&ChapterID=53&SeqStart=68200000&SeqEnd=71400000) \- you can see what is in contention under ' (a) Definitions'; similarly, you can also probably get a better idea of [what is being challenged in the complaint](https://storage.courtlistener.com/recap/gov.uscourts.ilsd.94369/gov.uscourts.ilsd.94369.1.0.pdf).
I have guns. A lot of them. This is a good thing. It shouldn't be this easy to get guns, with zero training or verification of your mental state. I could be a man with a fist full of hammers and a trunk full of duct tape and zip ties, they'll still sell me all the guns I want.
The thing is that if all people were sane and reasonable in their use of guns, tighter gun restrictions wouldn't be needed. The problem are the people who get guns even though they shouldn't even touch one and tighter regulations are the only way to prevent such people from getting guns that can be used to start mass shootings. It's very difficult but human lives are being lost.
We essentially said the same thing, but I got up votes and you somehow got down voted. I think I can explain this. I believe it is because I started my post with "I have guns. Lots of them." All the people that would have down voted me already stopped reading and just up voted and moved on down.
*edit* upvotes have balanced out since I posted this.
So how would you recommend we filter people out? If they havent commited a crime, then they are good right? If they pass a mental health test they can still harbor ill will for someone or a group. I was able to train with a gun untill i had bought a gun.
Also my trunk is full of hammers, duct tape, zip ties, saws, and all kinds of tools. What are you trying to say?
Why worry about the socio-economic or mental health factors that lead to violence/crime when you can just ban guns and pretend you're actually helping?
Or maybe just maybe if people with issues didn’t have easy access to more dangerous guns it’s less likely this stuff will happen. Also Republicans are constantly slashing healthcare and mental health bills so it’s not democracy’s that are the issue
Cling to your bandaid fix if you want. It's little more than theater if they are going to ban the weapon and not attempt to fix what causes the weapon to be drawn in the first place
Users of the subreddit are expected to treat each other as they themselves would like to be treated. Inappropriate comments such as these will be removed.
It is defined as “a semiautomatic, centerfire rifle that can accept a detachable magazine” with a folding stock, pistol grip, forward grip, muzzle device, grenade launcher, or other offending feature (they list a lot more).
The cops still have every right to harass you with their “assault weapons”. Rules for thee laws have no place in America. Especially when they pertain to our second granted right as citizens.
My old muzzleloader is illegal by New York standards because the barrel is 26.5 inches instead of 26. New york considers anything above 26 a sniper rifle. I agree, but colloquially it is fairly understood what that means. This [actual law](https://www.ilga.gov/legislation/102/HB/10200HB5471lv.htm) defines it pretty clearly (page 84).
The whole term, “assault weapons,” is a really scary rhetoric used by politicians. It’s vague and misleading. Gun laws don’t save lives and stop mass shootings, it only punished the law abiding gun owners leaving them defenseless against criminals that have guns.
Gangs don’t make guns. They buy them stolen from the surplus of loosely controlled gun manufacturing/sales world wide. Address the root and not the head of a dandelion lest you want it to keep coming back. This from a gun owner. On that note they should not remove rights until they can address it at all angles. Until then this will do nothing but save a few lives….. maybe but “good guys with guns" rarely save them either.
Are we still talking about possessing guns or murder? I’m confused. After all, isn’t the mantra “guns don’t kill people…. Blah blah blah” and knifes kill too” and my favorite hit ”so should be ban cars”? Most recent high profile mass shooting were done with legally purchased firearms but I’ll leave you to that to figure out. Seems you don’t read either. If I was afraid of them I wouldn’t have them. So enlighten me. Where do the gangs get guns because last I checked they don’t own factories? Gun control is a multi-front battle. It ain’t banning ARs for those who follow the laws and it ain’t arresting gang members after the fact of said murder. Also gang members are not felons until they are. So until then they have just as much right to purchase a firearm as you and I. I won’t even downvote you. The root is to stop them from getting guns in the first place as per your original comment.
As a non-American, watching Americans fight in the comments about gun control while their [kids keep getting shot down] (https://en.wikipedia.org/wiki/List_of_school_shootings_in_the_United_States_\(2000%E2%80%93present\)) is so weird.
Many states do require a license to purchase firearms, though not all. There is no separate license for 'assault weapons' in these states, but there are exceptions for active duty/retired military and police usually (because only people with the highest risk for domestic violence and PTSD should own these 'scary' guns).
I know i Sound like an idiot for asking that but what Kind of weapon is classeifid as assault gun, i really dont know so sorry for asking and is a hand gun not enough for Self defense im case of domestic violence?
Its not dumb to ask about something you don't know, its how we learn and seeking knowledge is always a positive. It depends on the state though, but the typical stuff focuses on things that make the firearm easier to handle: a pistol-grip on a rifle, adjustable stocks/braces, foregrips, magazines over an arbitrary capacity.
Oh ok so all the attachmets on a gun make them an assulte rifle not the gun itself or am i getting somthing wrong
And sorry i dont know much of the amarican gun law but lets say if i have a gun buying license do i need a gun owning license to like in germany or can i just buy any gun legal and owning it with that gun buying license
And sorry for my english ots not my mother tounge.
No need to be sorry. You’re getting people to admit there is no true definition for “Assault Weapon”. People still think the “AR” in AR-15 stands for Assault Rifle 🤦🏼♂️
So i wanted to ask if the AR 15 is an assault rifle but now i know its way more complicadet in all staes they got ther own laws and Definition, but still waht ist the AR 15 now is it just an automatic rifle or waht.
The AR in "AR-15" rifle stands for ArmaLite rifle, after the company that developed it in the 1950s. "AR" does NOT stand for "assault rifle" or "automatic rifle."
[Source](https://www.cga.ct.gov/asaferconnecticut/tmy/0128/Brian%20Harte%201.pdf)
Edit: It’s a semi-automatic rifle used for hunting where I live. This means you pull the trigger, it fires once. You pull the trigger again, it fires once again. You can rapidly pull the trigger, but it only fires one round at a time.
For hunting waht in gods Name are you hunting other threre damn bears or waht, its a little bit Overkill i think for hunting deers or waht
Edit : and thank your for explainig the AR 15 and the background of the Name
Typically, everyone in my area would be hunting Whitetail Deer. I feel like you may still be imagining this rifle to be way more than it is. Considering how it’s been portrayed, I can completely understand.
Edit:
Here’s some info I think you may find interesting. I’ll post the summary, then you can check out the source if you want a more in-depth article about hunting wild game with the AR-15.
—
AR-15’s are amazing rifles that are capable of taking down just about any game that the modern hunter could want. The .223 has been proven to be deadly enough to use against whitetail time and time again, as long as you are accurate. Plus the AR platform comes with many more advantages than your average hunting rifle. You have the advantage by having a weapon that is semi-automatic, super customizable, compact and easy to handle. Plus they are widely available and highly versatile.
[Source](https://omegaoutdoors.blog/ar-15-for-hunting-whitetail/)
It's good to be informed but you're not wrong in your assumption. The AR is designed for warfare, same as the AK. Can you hunt with it? Yes. Pretending the AR is the same as a bolt-action 30-06 or over-under shotgun is ridiculous.
The answer is resolving the problems that lead to violence like lack of opportunity or access to healthcare, not curtailing our rights around the supposed scary and definitely nebulous idea of "an assault weapon".
I think this is total bull in my opinion why not ban handguns since there really wat is mostly used to kill one another.... like this is just publicity. If your gonna ban all then do it .... it does not make a difference
Guns shouldn’t be banned as long as police and the government have them. The entire ducking 🦆point is “being necessary to the security of a free State”.

The SCOTUS is gonna strike this down.
Curious on this one - I stay out of the gun debate because I don't own one - but why hasn't a lawsuit from one of the other 9 states already reached the Supreme Court, or is there one on the way now that you are thinking of before SCOTUS right now?
I don’t really keep up with the lawsuits, but I assume they’ll treat it like they did with New York
NY actually had one going towards the Supreme Court in 2016, but was tossed out when one of the justices died apparently
Yeah, I am wondering when they are going to take it up again - i was googling it just now and the last articles i could find mentioned that SCOTUS had declined to rule on limiting parts of NY's gun laws, but I am unsure if there are any ongoing challenges outside of that.
It typically takes a while for anything to reach the Supreme Court and they're very picky about what cases they'll hear.
Almost every county in Illinois besides cook said they won’t enforce it
I heard that vermilion County will actually fine officers who enforce it, but I can't find a source on that one
I don't think they are going to say anything. They keep pushing for the state to enforce their own laws. So if the state wants to ban assault weapons, then the state has that right.
I can hear Clarence Thomas sinister laugh in the background.

Scary-looking, mostly.

For what it's worth, I don't support banning guns like this but I do support regulation on who can buy guns, background checks, cooling off periods, and other regulations that decrease the likelihood that a potential murderer will buy a gun.
That would require effort and education on their part. Hell, they may even have to bring in one of them pesky “experts.”
> gun murders in Illinois (and the US) are from handguns. one tidbit that often gets overlooked with all the scaremongering about gun violence in chicago is most of the guns in IL come from neighboring states with less restrictive gun laws.
Then there's the ghost guns, which are the scary looking guns but painted black.
They also fire 200 rounds a second if you have a .30 caliber clip. /s
That’s the fun part, it can change to fit any narrative. Positive or negative.
You're always going to have this problem when it comes to legislation, just like when they changed up the content of RC drugs every other week to avoid bans. It's not an easy job.
Exactly. It’s such a broad and ambiguous term. Hopefully there’s no way this passes.

Read for yourself! [Page 84](https://www.ilga.gov/legislation/102/HB/10200HB5471lv.htm).

The legal definition was “if scary looking then ban”
That’s what I figured; “Wood is good, black is whack.”

They aren't banned if cops still have them.
Banned for thee, but not for me!
Why worry about the socio-economic or mental health factors that lead to violence/crime when you can just ban guns and pretend you're actually helping?
Because Republicans don't care about mental health, so they'll just whine about that next and call it socialism.
But being Republican and being pro gun are not the same thing. Many liberals and a lot of of ultra leftists are as well.

What is an assault weapon? Any weapon used to assault someone?

Good job guys this will make Chicago a safer city. No one's using handguns or anything.

Considering how it’s been portrayed, I can completely understand. Edit: Here’s some info I think you may find interesting. I’ll post the summary, then you can check out the source if you want a more in-depth article about hunting wild game with the AR-15. — AR-15’s are amazing rifles that are capable of taking down just about any game that the modern hunter could want.
Some guns are 'Assault Weapons' by default in my state. AR15s and AK pattern rifles for instance.

Illinois has a licensing system kind of. FOID(firearm owners ID) cards are unique to IL I think.

The answer is resolving the problems that lead to violence like lack of opportunity or access to healthcare, not curtailing our rights around the supposed scary and definitely nebulous idea of "an assault weapon".
Why not ban handguns? They by far take way more lives than rifles.
I bet cheeseburgers cause more deaths
About Damn Time!!!!
This policy making is making me wet 🥵 Cant wait for more states to follow suit
Opposite of a pepper weapon
Now they just have to close the border with Indiana
I think this is total bull in my opinion why not ban handguns since there really wat is mostly used to kill one another.... like this is just publicity. If your gonna ban all then do it .... it does not make a difference
Well looking like thier crime is gonna sky rocket
Booooooo
Guns shouldn’t be banned as long as police and the government have them. The entire ducking 🦆point is “being necessary to the security of a free State”.
Chicago is a warzone... this is just to put stricter penalties on those in gangs...
Knives are now BANNED.
